IMPORTANT - PLEASE READ THIS ENTIRE AGREEMENT AND THEN PRINT AND STORE A PAPER COPY FOR YOUR RECORDS.
These terms and conditions constitute a legally binding agreement ("Agreement") between:
(a) you, the end-user, and
(b) PokerBot.com which is a DBA for HixoxiH Software.
1. Applicability of Terms and Conditions.
By attempting to download or install or execute WinHoldEm ("the software") on a computer system
you, the end-user, represent and warrant that you fully understand
and agree to comply with all of the following terms and conditions,
and that failure to abide by these terms and conditions may result in a suspended license,
and loss of any and/or all license fees unless otherwise noted.
PokerBot.com may from time to time offer a temporary product license for the purposes of product promotion or product testing. PokerBot.com reserves the right to expire or modify any temporary license with or without notice to the end-user. This entire agreement shall apply to any temporary license.
The WinHoldEm software is a download subscription software product. The length of the subscription, and the product capabilities, and the price will be clearly stated at the time the end-user purchases a license. The license will expire on the date shown on the end-user license presented by the PokerBot.com license server. The end-user must renew their license before the expiration date in order to avoid interrupted use of the software. PokerBot.com may send a courtesy expiration notice to the end-user via email but is not required to do so.
The WinHoldEm download software is made available at several different subscription levels. At any time, the end-user may upgrade an existing license to a higher subscription level. The end-user the shall be entitled to a pro-rated refund of their existing license. Any such refund will be credited back to the credit card of origin that was used to purchase the original license. The end-user shall be required to contact customer support and request the refund. All requests for pro-rated refunds shall be processed after the end-user purchases the higher level subscription and the subscription is approved. The pro-rated refund amount will be calculated on the time remaining on the previous license rounded down to the nearest tenth of a year.
WinHoldEm is a product under frequent even daily development and as such there may be unintentional errors or bugs that already exist in the software or that are introduced into the software. PokerBot.com and the principals involved shall not be liable for any undesired software behavior exhibited by WinHoldEm regardless of the extent of the behavior. If WinHoldEm does not behave according to end-user expectation, the end-user shall have no recourse, legal or otherwise, whatsoever, save that of declining to run the software. The end-user shall not have the right to a refund of any portion of any license fees paid. PokerBot.com is a business like any other and desires to provide high quality software for the benefit of the end-user and PokerBot.com desires to correct undesirable behavior in the software in a quick and satisfactory manner. PokerBot.com is not obligated to correct undersirable behavior in the software.
WinHoldEm is a download product and PokerBot.com desires to provide a safe and secure end-user software delivery system via the internet. The end-user is responsible to provide computer virus protection for any computer system where the end-user intends to execute WinHoldEm or any PokerBot.com download software. The end-user shall be responsible to scan any and all download executables from PokerBot.com using the best virus detection products available to the end-user. PokerBot.com shall not be liable for any virus infected software whatsoever. The end-user is further advised to download WinHoldEm installs and upgrades from PokerBot.com only in order to reduce the risk of virus infection.
The end-user agrees to only execute and run the software in the exact binary form that exists at the PokerBot.com download server as contained in the executable file named "winholdem.exe"; Furthermore the end-user agrees that this binary form shall constitute the only acceptable executable form of the software. The end-user shall not modify the WinHoldEm software executable in anyway whether on disk or in computer memory either before during or after execution on any computer system past present or future. The end-user shall not attempt to disassemble or attempt to reverse engineer the software. Modifying the acceptable binary form of the software is grounds for immediate revocation of license. The license reinstatement fee for violating binary sanctity shall be at the sole discretion of PokerBot.com.
The end-user is hereby notified that they should read the terms and conditions for any opc before they download or install or run or use the opc poker client in conjunction with the WinHoldEm software. PokerBot.com is not liable for any opc action toward the end-user for downloading or installing or running or using the WinHoldEm software.
The WinHoldEm software uses state of the art image recognition techniques able to determine the state of an online Texas Holdem poker game at several supported opc sites. PokerBot.com desires to support as many opc sites as possible, but is under no obligation to do so. The end-user is hereby notified that any supported opc site may without any notice to the end-user, modify their software such that the WinHoldEm software might not recognize the state of the poker game. The end-user is without recourse should this occur, save that of filing a complaint with their opc. PokerBot.com desires to maintain the highest image recognition capability possible and desires to release new scraper updates in a quick and satisfactory manner such that the poker game state can be recognized. However, PokerBot.com is not obligated to provide any such scraper update.
The WinHoldEm software is a normal user friendly window process that runs on several supported end-user operating systems. The end-user is hereby notified that any opc may attempt to detect the WinHoldEm software and that the opc may instruct their poker software to operate incorrectly or not at all. The end-user is without recourse in this event, save that of filing a complaint with their opc. PokerBot.com desires to provide the end-user with the best pokerbot possible. And as such, PokerBot.com may implement, opc detection countermeasures that will allow the end-user to run WinHoldEm undetected by their opc. However, PokerBot.com is not obligated to provide any such counter-measures.
WinHoldEm will generate a 32 character client product key for the purposes of identifying the end-user install of WinHoldEm software. The end-user product key will be stored on the end-user computer. The end-user is advised to look at their product key and write it down on the printed copy of this license agreement. The end-user is responsible to keep their product key safe. The end-user product key and license are not transferable. The end-user agrees to contact WinHoldEm support in the event their key is lost or stolen.
The end-user is responsible to maintain a working valid email address that is registered with the WinHoldEm.net license server. PokerBot.com requires the end-user email address in order to provide various pertinent end-user notifications.
The end-user is responsible for all software settings that direct the course of play chosen by WinHoldEm. The end-user is responsible for all playing formulas that are used to operate the WinHoldEm pokerbot. The end-user is hereby advised to understand any new playing formula before installing it in WinHoldEm.
a)
The WinHoldEm Team edition allows 2 or more end-users to transfer chair and card information
via a secure private communication channel at winholdem.net.
It may be necessary from time to time to take the channel server offline for maintenance and security upgrades.
The channel server can be taken offline at anytime with or without notice to the end-user.
PokerBot.com is not obligated to notify the end-user about this event.
The end-user has no recourse during channel server downtime other than to use an alternate means
of communication. The end-user assumes all responsibility for any alternate means used.
b) Any connection made by WinHoldEm to the winholdem.net secure channel server occurs only after
the end-user indicates the desire to do so by pressing the 'connect' button.
WinHoldEm never attempts to connect to the channel server or any other internet server
at any time during software execution,
save for one-time connection to the license server at startup.
c) PokerBot.com desires the best security possible for the end-user.
As such, only the following pieces of end-user information are transmitted to the end-user secure channel:
- end-user product key (for license verification)
- end-user macadr (for license verification)
- end-user chair number (0-9) based on where the end-user is seated
- end-user card information (1-52) based on cards dealt to the end-user
The product key and macadr never leave the channel server and are for license verification only.
The end-user chair number and end-user card information is sent only to the end-users connected
to the secure channel.
d) The WinHoldEm software uses Blowfish encryption with an undisclosed key length.
The end-user is hereby notified that PokerBot.com will disclose the blowfish encryption key
to any United States official security agency operating under the authority of
the Department Of Homeland Security upon request, provided that agency demonstrate
a need to know urgency in the interest of preventing terrorism.
e) The WinHoldEm software does not have the ability for player chat nor does it have the ability
to aid and assist the end-user in locating other willing teammates.
The end-user is required to use an alternate means of communication if they desire to contact teammates and make playing arrangements.
The WinHoldEm software does not have the ability to communicate secure channel numbers to other end-users.
The end-user is required to use an alternate means of communication
if they desire to transmit their private channel number to a teammate.
f) The end-user agrees to read the help documentation and learn how to properly use a
winholdem.net secure channel before attempting to team.
g) Voting Mode. The end-user agrees to read the help documentation on voting and learn how to
properly learn to use voting mode before attempting to practice voting in an actual game.
h) Observer Mode. The end-user agrees to read the help documentation on observer mode and learn how to
properly learn to use Observer mode before attempting to practice observing in a real game.
i) The end-user is further notified that redirecting their otherwise normal course of action,
during an online poker game (where team play is not allowed),
as a direct result of having teammate card knowledge puts the end-user at risk of detection by the opc.
The end-user is hereby advised to read the opc policies related to teaming and card sharing.
PokerBot.com is not liable for any opc action toward the end-user accused of violating any opc
policy including but not limited to teaming and card sharing.
15. Entire Agreement, Modification and Amendments..
You fully understand and agree to be bound by the terms and conditions contained herein and as modified and/or amended from time to time. PokerBot.com reserves the right to modify and amend this Agreement at any time with or without notice to the end-user. Such amendments will become effective immediately upon being posted at PokerBot.com. It is your sole responsibility to review this Agreement and amendments hereto each time you play. The terms and conditions contained herein represent the complete and final agreement between you and PokerBot.com and supersede any and all prior agreements, representations or statements made by PokerBot.com.
